1. Acceptance of Terms
ChartAlert® — collectively, "We" "Us" — provide, via the Internet and a leased software, the technical analysis of the historical price movement and market commentaries on the probable future market price trends related to companies whose securities are publicly traded on the stock markets and related to commodities that are publicly traded on the commodity markets — collectively, the "Research" or "Service" — subject to the following Terms of Use and/or Service, which may be updated by us from time to time without advance notice.
2. Availability of Services
The financial or asset market advisory services, provided on this site or via our technical analysis advisory, charting and scanning software viz. ChartAlert®, comprises Technical Analysis of the historical price movement and market commentaries on the probable future market price trends related to companies whose securities are publicly traded on the stock markets and related to commodities that are publicly traded on the commodity markets — collectively, the "Research". The Research is provided to you as a source of information only and no content included in the Research is intended for trading or investing purposes. Furthermore, the Research on this site and/or software is provided to you no more than as a means of support services offered by ChartAlert® for the community of individuals referring to its Research.
The Research is provided on an "AS IS" basis. Furthermore, the Research is provided for a period of 46 weeks in a calendar year of 52 weeks. Hence, under the 3-month subscription plan, Research will be available for a period of 11 weeks out of 13 calendar weeks, under the 6-month subscription plan, Research will be available for a period of 23 weeks out of 26 calendar weeks, and under the 12-month subscription plan, Research will be available for a period of 46 weeks out of 52 calendar weeks.
No Research is provided by ChartAlert for a period of 6 weeks in a calendar year of 52 weeks. This hiatus period of 6 weeks, spread across Diwali, calendar year-end and summer.
3. Termination and Cancellation
The rights granted to you to use the Research or Service shall remain in full force and effect unless terminated or cancelled.
You acknowledge and agree that we may terminate or cancel your account or software lease or deny you access through ChartAlert to any materials stored on the Internet, or in the leased software on your computer, or to access third party services, merchandise or information on the Internet or in the leased software through ChartAlert, without prior notice, at any time, and for any reason, at our discretion, including, but not limited, for any of the following reasons:
- for any unauthorized access or use by you;
- if you assign or transfer any rights granted to you;
- if you violate any of the terms and conditions;
- if you engage in any conduct or activities that is otherwise inappropriate for your continued access.
You acknowledge and agree that we shall have no responsibility to notify any third-party providers of services, merchandise or information nor any responsibility for any consequences resulting from lack of notification.
Termination or cancellation of this agreement shall not affect any right or relief to which we may be entitled, at law or in equity. Upon termination or cancellation of this agreement, all rights granted to you to use the Service will terminate immediately and revert to us. Except as set forth herein, regardless of the reason for termination or cancellation of this agreement, the fees charged for access to the Service is non-refundable for any reason.
4. Refund Policy
You may cancel or terminate usage of the Service at any time by closing your account, or ceasing to use the Service. In such an event, you will not be entitled to any refund of the Evaluation Trial, Subscription Charges and the Subscription Renewal Charges you may have paid prior to you ceasing to use the Service.
5. Indemnity and Limitation of Liability
You agree to defend, indemnify and hold us, our affiliates, our directors and employees and agents, harmless from any and all claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or related to (a) any actual or alleged breach of these Terms of Use and/or Service or any other terms, policies or guidelines provided by us; (b) your wrongful or improper use of the Research/Services or the placement or transmission of any message, information, software or other materials through the Research/Services by you as a user of your account; or (c) your violation of the rights of any third party.
You also agree that the online payment gateways, payment system providers, their contractors, their affiliates, and their directors and employees and agents, through whom the online payments are processed are not liable for any claims against any lack or deficiency of our Services, non-fulfillment or unsatisfactory fulfillment of products and/or Services purchased by you from us, and thus, they shall not have any liability whatsoever for any aspect of the arrangements between you as a user of your account and us.
